If Eric Benét has his way, his prenuptial agreement with Halle Berry will end up as shredded as her ”Catwoman” costume. In a June 1 Los Angeles Superior Court filing, the singer and soon-to-be-ex-husband of the Oscar-winning actress responded to her April petition for a divorce by seeking a bigger slice of the estranged couple’s assets and challenging their prenup. In the filing, which is posted online at The Smoking Gun, Benét petitions for spousal support, payment of his legal bills, and a court ruling to ”determine the validity and/or enforceability of the parties’ prenuptial agreement and subsequent amendments thereto.”
Benét became Berry’s second husband in January 2001. (She was previously married for four years to Cleveland Indians outfielder David Justice.) The couple, who faced rumors of his infidelity throughout their marriage, separated last fall, with Berry saying, ”Eric and I have had marital problems for some time now.” When she filed for divorce in April, Berry attorney Neal Hersh told TV’s ”Celebrity Justice,” ”So far the divorce is amicable, and I expect it to stay that way.” Guess not.
