Despite news that AC/DC drummer Phil Rudd has been accused of attempting to hire a hitman and of drug possession, the band has announced that they will move forward with their upcoming tour and still plan on releasing their Rock or Bust album.

“We’ve only become aware of Phil’s arrest as the news was breaking,” the band announced in a statement on Thursday. “We have no further comment. Phil’s absence will not affect the release of our new album Rock or Bust and upcoming tour next year.”

Rudd appeared in a New Zealand court on Thursday and was charged with attempting to procure murder of two people, threatening murder, and meth and marijuana possession, according to The Associated Press. He has been released on bail and is due back in court on Nov. 27.

Rock or Bust is slated for a Dec. 2 release.
