Mischa Barton sues her mother for stolen earnings

Mischa Barton has officially filed a complaint against her mother/manager, Nuala Barton.

In the complaint, filed yesterday, Barton brings five charges against her mother: complaint for breach of fiduciary duty, fraudulent misrepresentation, breach of oral contract, breach of the implied covenant of good faith and fair dealing, and conversion.

As the suit states, “This action arises from the tragic tale of a greedy stage mother posing as a talent manager who, instead of acting in the best interest of her daughter/client, schemed to defraud her unsuspecting victim.”

Among other charges, the suit claims that Nuala kicked Mischa out of a home that Mischa bought. Because of that, Mischa is looking to recover the money that was stolen from her. The suit also claims that Nuala exposed her daughter to “legal liability by entering her into contracts for the endorsement of certain products without first informing Barton of her obligations under said contract.”

Bringing up exploitation, the suit cites Mischa’s handbag line and fashion boutique, which she says she was never compensated for in terms of the use of her name, image, and likeness. The suit states: “While Barton was busy perfecting her craft and turning her acting dreams into reality, her mother, Nuala, was secretly scheming to exploit Barton’s burgeoning career for her own selfish benefit.”

As a result of the complaint, Mischa is looking to receive damages and is demanding a jury trial.
