Good thing Nyle DiMarco isn’t judging the judges on Dancing with the Stars, because he’d probably be handing out a few 4 or 5s this season.

On tonight’s installment, the America’s Next Top Model victor thought he earned two 10s and a 9 after performing a foxtrot to U2’s “Beautiful Day” with Peta Murgatroyd. Instead, DiMarco got an instant replay of what happened April 18, when he thought he earned three 10s and one 9 from the four judges but in reality, only got one 10 and three 9s.

Because the only scores that matter are the ones the judges write down on paper and give to the producers. So even though Bruno Tonioli flashed a “10” paddle tonight, he wrote down a 9. So DiMarco got one 10 and two 9s for a dance that seemed to blow away the judges.

“Do you do your own taxes?” Tom Bergeron quipped to Tonioli.

The last time DiMarco missed out on a 10, he told EW backstage that he thought the judges subconsciously wanted to give him a perfect score. “Honestly I think what probably happened is that’s what they really wanted to give me but I’m not sure how to describe it,” he told EW. “Subconsciously they wanted to give me those 10s. Who knows? It’s still better for me next week.”
