In August, they got married, and in December, police were called to their home. According to the Los Angeles Sheriff's Department, Josh Brolin was arrested on a domestic battery charge in the wee hours of Sunday morning at the home he shares with wife Diane Lane. Police responded to a call from the Unfaithful actress, officer Grace Brady told the New York Daily News. The Oscar-nominated leading lady dismisses the incident, however, as a misunderstanding that went too far, according to a representative for the couple.
''There was a misunderstanding at their home,'' spokeswoman Kelly Bush told the Daily News. ''Diane called the police. Josh ended up being arrested for the lowest-end misdemeanor charge of domestic battery.'' Bush added, ''Diane did not want to press charges and asked them not to arrest him, but in cases involving the possibility of any physical contact, the police have to arrest first, ask questions later.'' Brolin was booked and released on $20,000 bail, according to the sheriff's department. ''They are home together and are embarrassed the matter went this far,'' Bush said of the newlywed actors. The Daily News also cited a friend of the couple who said neither spouse was injured. Still, Brolin faces a court date on the misdemeanor charge on Jan. 13, the sheriff's department said.
